What is the process of adopting a stepchild in New York?

Even if you have been raising your stepchild as your own, you may lack important parental rights. If something happens to your spouse, you could face challenges regarding custody or medical decisions. Stepparent adoption provides the legal recognition needed to secure your relationship with your child.

What are the requirements for a stepparent adoption?

To start a stepparent adoption in New York, you must be legally married to the child’s biological parent. You may initiate the process before the required six-month residency period ends. However, the court will not finalize the adoption until this period is complete.

The petition is typically filed either in Family Court or Surrogate’s Court in the county where you reside. This includes information about you, your spouse, the child and the other biological parent. You must also submit supporting documents such as marriage certificates and birth certificates.

How do consent and termination of parental rights work?

Once you file a petition, you generally need consent from the other biological parent. This consent ends their parental rights and obligations. The consent must be given voluntarily and in writing before a judge.

However, the court may proceed without consent in certain situations. These include when the other parent has abandoned the child or failed to provide support for six months. If you cannot locate the other parent, you must show proof of your search efforts.

What happens during the home investigation?

New York law requires an investigation of your home before finalizing an adoption. An authorized agency or court investigator visits your home. The investigator conducts interviews and reviews your relationship with the child. This evaluation also assesses your ability to provide proper care.

This investigation is usually less detailed for stepparent adoptions. This is because a family relationship already exists.

What can stepparents expect at the finalization hearing?

After the investigation, the court schedules a finalization hearing. The judge reviews all documentation, including the petition and the investigation report.

Upon approval, the judge issues an adoption order. This legally makes you the child’s parent with full rights and responsibilities. The court then orders an amended birth certificate. This certificate reflects your parental status and may include any name changes for the child.
